DMCA Copyright Policy
Copyright owners, and people acting for them, can ask 9Sixteen Apparel to remove material they believe infringes. Notices and counter-notices work as described here.
Policy statement
We want artists to be credited and paid, and we do not want infringing material listed on 9sixteenapparel.com. Should you conclude that a design, photo or text here copies a work whose copyright belongs to you or to a client, send a notice with the elements listed below. We follow 17 U.S.C. § 512, the takedown framework Congress set out in the DMCA.
Required elements of a notice
A valid written notice includes every item below:
- Signature. Signed, physically or electronically, by the rights owner or by someone with authority to sign for that owner.
- The work. Which copyrighted work you say has been infringed; one notice covering many works can use a representative list.
- The material. Which item on our site you say infringes, plus enough location detail for us to find it, ideally the complete URL of every page involved.
- How to reach you. Your name, postal address, phone number and email.
- Good faith. Your declaration that you believe in good faith that neither the owner, nor an agent of the owner, nor the law permits the use complained of.
- Accuracy and authority. You affirm the notice is correct and, on penalty of perjury, that the right is yours or you are empowered to enforce it for its holder.
Sending a notice
Address it to 9Sixteen Apparel, Attn: Copyright Agent, and send it to [email protected] with the subject “DMCA Notice”. You will find our business details at the foot of this page.
Review and removal
We act quickly on complete notices: material that looks infringing is taken down or blocked, and where suitable the person who supplied it is told.
Counter-notification
Was something of yours taken down in error or because it was misidentified? Email a counter-notice to that same inbox containing:
- Signature. Your physical or electronic signature.
- Removed content. Name the item we disabled and the page address it used to occupy.
- Sworn statement. On penalty of perjury, you state an honest belief that the removal came from an error or from identifying the wrong material.
- Identity and consent. Full name, street address and a phone number; your agreement to be subject to the U.S. federal district court covering the district where you live (or, for addresses abroad, to any district where 9Sixteen Apparel can be found); and your agreement to accept legal papers served by the sender of the original notice or by someone acting for them.
A valid counter-notice may be passed on to whoever filed the first notice. Following Section 512(g), the material can then go back up unless that party reports a court case filed against you.
Repeat infringers
Anyone shown to infringe again and again loses access to our store in addition to having the material removed.
Misrepresentation
False notices have consequences: under 17 U.S.C. § 512(f), whoever knowingly misstates infringement, or a mistaken takedown, can owe damages plus costs and attorneys’ fees.
